End-User License Agreement

01 Scope of License

Upon valid purchase and payment, mediaXtreme LLC grants you a limited, non-exclusive, non-transferable, revocable license to install and operate the Software on one (1) designated server or virtual private server ("VPS") for single-user, single-deployment use only.

• The license is permanently bound to the hardware identifier ("HWID") of the client's designated VPS, registered and locked at the time of first activation.
• Each license entitles exactly one (1) user to operate the Software on exactly one (1) machine. If you require deployment on multiple VPS machines, you must purchase a separate license for each machine.
• You may not transfer, sublicense, share, lease, rent, lend, or assign your license to any other individual, entity, organization, or hardware without prior written consent from mediaXtreme LLC.
• HWID migration requests may be submitted to support and are handled at our sole and absolute discretion. Approval is not guaranteed.
• mediaXtreme LLC reserves the right to revoke this license at any time, for any reason, including but not limited to violation of this Agreement.

02 Restrictions on Reverse Engineering & Redistribution

You expressly acknowledge and agree that the following activities are absolutely prohibited:

• Decompiling, disassembling, reverse engineering, or otherwise attempting to derive the source code, underlying algorithms, data structures, or architecture of the Software, in whole or in part.
• Modifying, adapting, translating, altering, or creating derivative works based upon the Software or any component thereof.
• Redistributing, reselling, leasing, renting, lending, sublicensing, publishing, or otherwise making the Software available to any third party by any means.
• Removing, altering, concealing, or obscuring any proprietary notices, labels, watermarks, HWID enforcement mechanisms, or branding within the Software.
• Circumventing, disabling, tampering with, or otherwise interfering with any license enforcement, HWID binding, activation, or security features of the Software.
• Using any automated tools, scripts, or methods to bypass, crack, or defeat the license validation system.

Any violation of this section constitutes grounds for immediate license revocation without refund and may result in legal action.

03 Data Sovereignty — Self-Hosted Private Infrastructure

Super LeadStorm is a self-hosted software platform. All data collected, processed, and stored by the Software during operation remains exclusively on infrastructure owned by, leased by, or otherwise under the direct control of the Licensee.

• The Licensee is the sole Data Controller (as defined under the EU General Data Protection Regulation "GDPR", the California Consumer Privacy Act "CCPA", and all other applicable data protection legislation) for all campaign data, lead data, contact information, and any other personal or business data processed by the Software.
• mediaXtreme LLC does not access, collect, receive, store, process, or have custody of any end-user campaign data, lead lists, contact databases, email content, or any other data generated or processed by your deployment of the Software.
• mediaXtreme LLC bears no responsibility or liability for the Licensee's data handling practices, data protection compliance, or any data breaches occurring on the Licensee's infrastructure.
• It is the Licensee's sole responsibility to ensure compliance with all applicable data protection laws, privacy regulations, anti-spam legislation (including CAN-SPAM, GDPR, CCPA, CASL, PECR, and any other relevant statutes) in their jurisdiction and the jurisdictions of their data subjects.

04 VPS & Installation Services

mediaXtreme LLC may offer optional VPS hosting recommendations and managed installation services as a convenience to the Licensee.

• VPS hosting costs are separate from the Software license fee and are billed independently by the third-party hosting provider selected by the Licensee or recommended by mediaXtreme LLC.
• Managed setup services include initial installation, configuration, and deployment of the Software on the Licensee's designated server.
• Third-party hosting providers operate under their own terms of service, and their separate terms, SLAs, and privacy policies apply independently.
• mediaXtreme LLC is not liable for any downtime, data loss, performance degradation, service interruptions, security breaches, or any other issues caused by or attributable to third-party hosting providers.
• Ongoing VPS costs, maintenance, and renewals remain the sole responsibility of the Licensee. Failure to maintain hosting does not entitle the Licensee to any refund or credit.

05 Acceptable Use Policy

You agree to use the Software only for lawful purposes and in a manner consistent with all applicable laws and regulations. You are expressly prohibited from using the Software to:

• Send, distribute, or promote content that is illegal, unlawful, or violates any applicable local, state, national, or international law or regulation.
• Send, distribute, or promote content that is defamatory, libelous, slanderous, or injurious to any person or entity.
• Send, distribute, or promote content that is obscene, pornographic, sexually explicit, or otherwise offensive.
• Send, distribute, or promote content that constitutes harassment, threats, intimidation, stalking, or bullying of any individual or group.
• Send, distribute, or promote content that promotes, incites, glorifies, or facilitates violence, terrorism, or physical harm against any person, group, or property.
• Send, distribute, or promote content that infringes upon, misappropriates, or violates the intellectual property rights, copyrights, trademarks, trade secrets, or other proprietary rights of any third party.
• Use the Software for any form of fraud, phishing, identity theft, or other deceptive or criminal activities.

mediaXtreme LLC reserves the right to revoke your license immediately and without prior notice upon discovery of any violation of this Acceptable Use Policy. No refund, credit, or compensation of any kind shall be provided upon revocation for violations of this section.

06 Intellectual Property

All intellectual property rights in and to the Software, including but not limited to all source code, object code, compiled binaries, architecture, algorithms, logic, data structures, design, user interface, user experience, documentation, branding, logos, trade names, and trade secrets, are and shall remain the sole and exclusive property of mediaXtreme LLC.

• Your purchase grants a limited license to use the Software as described herein. It does not grant ownership of, or any proprietary interest in, any intellectual property of mediaXtreme LLC.
• No rights are granted by implication, estoppel, or otherwise, except as expressly set forth in this Agreement.
• All feedback, suggestions, bug reports, feature requests, or improvements you provide regarding the Software become the unrestricted property of mediaXtreme LLC without any obligation, compensation, or attribution to you.
• The Software name "Super LeadStorm", the mediaXtreme name, and all associated logos and branding are trademarks of mediaXtreme LLC and may not be used without express written permission.

07 Disclaimer of Warranties — "AS-IS"

THE SOFTWARE IS PROVIDED "AS-IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MEDIAXTREME LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
• ANY IMPLIED WARRANTY OF NON-INFRINGEMENT OR TITLE.
• ANY WARRANTY THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS, EXPECTATIONS, OR SPECIFIC BUSINESS OBJECTIVES.
• ANY WARRANTY THAT THE SOFTWARE WILL OPERATE WITHOUT INTERRUPTION, ERROR, DEFECT, OR DELAY.
• ANY WARRANTY REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF RESULTS OBTAINED THROUGH USE OF THE SOFTWARE.

YOU ACKNOWLEDGE THAT THE SOFTWARE IS A TOOL AND THAT RESULTS DEPEND ENTIRELY ON YOUR OWN CONFIGURATION, CONTENT, INFRASTRUCTURE, COMPLIANCE WITH APPLICABLE LAWS, AND USAGE PRACTICES. MEDIAXTREME LLC MAKES NO REPRESENTATIONS OR GUARANTEES REGARDING DELIVERABILITY, OPEN RATES, RESPONSE RATES, LEAD QUALITY, OR CAMPAIGN SUCCESS.

08 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO LEGAL THEORY—WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE—SHALL MEDIAXTREME LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY:

• DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND.
• LOSS OF PROFITS, REVENUE, BUSINESS, BUSINESS OPPORTUNITIES, GOODWILL, OR ANTICIPATED SAVINGS.
• LOSS OF DATA, DATA CORRUPTION, OR DATA BREACHES ON YOUR INFRASTRUCTURE.
• VPS DOWNTIME, SERVER FAILURES, HOSTING PROVIDER ISSUES, OR INFRASTRUCTURE OUTAGES.
• LEGAL FEES, REGULATORY FINES, OR PENALTIES ARISING FROM YOUR USE OF THE SOFTWARE.
• CAMPAIGN FAILURE, POOR DELIVERABILITY, LOW RESPONSE RATES, OR ANY OTHER PERFORMANCE-RELATED OUTCOMES.

THIS LIMITATION APPLIES REGARDLESS OF WHETHER MEDIAXTREME LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF WHETHER ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

09 Maximum Liability Cap

Notwithstanding anything to the contrary in this Agreement, the total cumulative liability of mediaXtreme LLC arising out of or related to this Agreement, whether in contract, tort, strict liability, or any other legal theory, shall not exceed the total amount actually paid by you to mediaXtreme LLC for the Software license during the three (3) months immediately preceding the event giving rise to the claim.

• This cap applies to all claims in aggregate, not per incident.
• This limitation shall apply even if mediaXtreme LLC has been advised of the possibility of damages exceeding this amount.
• The existence of more than one claim shall not enlarge or extend this cap.

10 Termination

mediaXtreme LLC reserves the right to terminate or suspend your license immediately, without prior notice or liability, for any violation of this Agreement, including but not limited to:

• Violation of any provision of this End-User License Agreement.
• Unauthorized redistribution, sharing, duplication, or resale of the Software.
• Attempts to reverse engineer, decompile, disassemble, modify, or circumvent license enforcement mechanisms.
• Use of the Software in violation of the Acceptable Use Policy.
• Use of the Software for illegal, fraudulent, or unauthorized activities.
• Filing a chargeback or payment dispute without first contacting our support team.

Upon termination: (a) your license is immediately and permanently revoked; (b) you must immediately cease all use of the Software; (c) you must destroy all copies of the Software in your possession; (d) your HWID activation will be deactivated; (e) no refund, credit, or compensation of any kind will be issued for termination due to violation.

11 Governing Law & Jurisdiction

This Agreement shall be governed by, and construed and enforced in accordance with, the laws of the State of Florida, United States of America, without regard to its conflict of law provisions or principles.

• Any disputes, claims, or controversies arising under, out of, or in connection with this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Florida, United States.
• You irrevocably consent to personal jurisdiction in such courts and waive any objection to the laying of venue or the convenience of such forum.
• If any provision of this Agreement is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
• The failure of mediaXtreme LLC to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
